As of October 17, 2023, the General Medical Council (GMC) mandates that all doctors and surgeons in the UK must have sufficient protection. While NHS indemnity covers practitioners; the majority are unaware that this safeguard doesn’t extend to locum work. Furthermore, it does not extend to ‘Good Samaritan’ acts, or private practice. Consequently, patients may face the daunting prospect of suing surgeons directly in the event of a claim. This is with potential financial repercussions if the surgeon lacks the means to compensate.

A staggering 80% of surgeons heavily rely on medical defence organizations (MDO) for insurance. Recognizing the far-reaching implications for patients, CBS advocates for a transition from discretionary cover to contractual cover. The latter would be closely monitored by financial authorities, ensuring transparency and adherence to contractual parameters.
